Please read these Terms carefully before using Sillage. By downloading or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app.
These Terms of Use ("Terms") constitute a legal agreement between you ("User") and Yoann Auger, an individual developer ("Developer", "we", "us"), governing your use of the Sillage iOS application ("App"). Apple Inc. is not a party to these Terms.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple device that you own or control, solely for your personal, non-commercial purposes.
You may not: sublicense, sell, resell, transfer, or assign the App; reverse-engineer, decompile, or disassemble the App; use the App in any unlawful manner; or use automated tools to access or scrape the App's content.

Sillage is free to download and use with the following limitations:

Subscription plans automatically renew at the end of each billing period unless cancelled. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
Prices are in US dollars and may vary by region. Applicable taxes are added where required by law.
You may cancel a subscription at any time through iOS Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period; you retain access to premium features until then. We do not provide refunds for unused portions of a subscription period, except where required by applicable law.
Free users receive 3 lifetime identification scans. Premium subscribers have unlimited scans for the duration of their active subscription.
If you reinstall the App or switch devices, you can restore your active subscription via the "Restore purchases" option in the App. Your subscription will be re-linked automatically as long as you sign in with the same Apple ID.
You retain ownership of content you create within the App (collection entries, notes, photos). By uploading content, you grant us a limited license to store and display it solely for the purpose of providing the service to you. We do not share your content with other users.
You are responsible for ensuring you have the right to upload any photos or other content to the App.
You agree not to use the App to:
The App, including its design, code, graphics, and all content we provide (excluding user-generated content), is owned by Yoann Auger and protected by intellectual property laws. "Sillage" and the associated logo are proprietary marks. You may not use them without our prior written consent.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.
Identification results are provided for informational purposes only. We do not guarantee the accuracy of any fragrance identification.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOANN AUGER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
This EULA is between you and Yoann Auger, not Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; or (iii) claims arising under consumer protection or similar legislation.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France, unless mandatory consumer protection laws in your jurisdiction provide otherwise.
We may update these Terms from time to time. We will notify you of material changes via in-app notice or email. Continued use of the App after changes constitutes acceptance of the updated Terms.
